Is obscene gestures, cursing that are result of an anger considered a intentional infliction of emotional tort? - gestures have a pokemon

Obscene gestures and cursing as a result of anger against a person is considered intentional infliction of emotional distress crime? I need to be mentioned in the evidence of emotional distress because any negative impact on health can be considered before the intentional infliction of emotional distress are CRIME?

Probably not ... obscene gestures and verbal abuse are not capable of sufficient weight to the Court to him with the charge of "scandalous" that one of the elements of IIED's meet demands.

IIED expert opinion is required to show the impact of injuries, at least in Tennessee, anyway. Make sure that the local laws to determine if the same true in your jurisdiction.

If I am a lawyer, I would say yes. I paid $ 200 per hour, and I sue the man for you.

But as evidence of the healthy people, I would say no. The person making the oath and the use of gestures is obviously emotionally disturbed and ask myself, what did you do for him. Maybe I have to be continued.
